Terms of use — Camily

Camily is an aid. You remain responsible.

These terms apply to the Camily app, the guardian web app, and related services run by NeoSpark Solutions, Sydney, Australia. By creating an account or pairing a room phone you accept them. Effective 29 September 2026.

Read this first

Camily is an assistive "worth checking" aid. It is not a medical device, not a monitored alarm service, and not an emergency service.
Camily does not replace supervision, care, judgement, or your responsibility for the person being watched.
Camily can miss real events and can raise alerts when nothing is wrong. Treat every alert as a prompt to check, never as a diagnosis.
In any emergency, call 000 (Australia) or your local emergency number first. Do not wait for, or rely on, a Camily alert.

1. What Camily does

A spare phone placed in a room runs on-device posture and motion analysis and reports simple status and alerts to people you authorise. It tells you when something looks worth checking, and it tells you honestly when it cannot see (for example when the room is dark, the camera is covered, the phone is off, or it has lost connection).

2. What Camily is not

Not a medical device. Camily is not certified, approved, or intended to diagnose, treat, monitor a medical condition, or prevent injury.
Not a fall detector with guaranteed accuracy. Fall-like activity detection is best effort. A person can fall with no alert, and an alert can fire when nobody fell.
Not an emergency or response service. Camily sends notifications to the people you choose. Nobody at NeoSpark watches your rooms, responds to alerts, or arranges help.
Not a substitute for care. Do not reduce, delay, or change any care, supervision, medication, or safety arrangements because Camily is running.

3. Your responsibility stays with you

You remain responsible for the safety and wellbeing of the person being watched at all times. You must:

Respond to alerts yourself and check on the person directly when in doubt. A "monitoring" status is not proof that everything is fine.
Check that the room phone is powered, positioned, connected, and actually monitoring. The app shows its reported state; it is your job to act when it says stopped, dark, blocked, or unreachable.
Keep guardian devices, accounts, and pair codes in trusted hands. Anyone holding a fresh pair code can attach a phone to the room.
Have the legal authority and the informed consent of the person (or their lawful guardian) before a camera watches them, and keep that consent current.

4. Accuracy, availability, and honest states

Camily is provided as is and as available. Analysis happens under real-world constraints: lighting, occlusion, camera angle, battery, network, and on-device processing. There is no guarantee that:

any particular event will be detected or that detection will be timely,
an alert will reach a guardian phone (delays, silenced notifications, offline devices),
the service will be continuously available or free of errors,
status shown in the app reflects the current moment rather than the last heartbeat received.

Where Camily cannot verify monitoring it says so. A green tile means the phone recently reported healthy monitoring, nothing more.

5. Privacy and providers

Data handling is described in the privacy notice. If you share a resident with a care provider organisation, that provider sees status and alerts only while your delegation is active; you can revoke it at any time. Delegation never transfers your responsibilities under these terms.

6. Acceptable use

Use Camily only for rooms and people you are authorised to watch. You must not use it to monitor anyone without lawful consent, to harass or surveil third parties, or in any way prohibited by law. We may suspend accounts that breach this.

7. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law or other law that cannot be excluded. Otherwise, to the maximum extent permitted by law, NeoSpark Solutions is not liable for any loss, injury, or damage arising from use of or inability to use Camily, including missed alerts, false alerts, service interruption, or failure to detect an emergency. If our liability cannot be excluded but can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.

8. Changes

If these terms change in a way that matters, we will ask you to re-confirm them in the app before you continue. The current version is always at camily.app/terms.html.

In plain words: Camily helps you notice things. It does not watch instead of you, it is never the reason to delay calling for help, and the care decisions stay yours.
